MediaMagnitude Privacy Policy

MediaMagnitude (the “Panel” or “we”) is a market research panel administered by HyphaMetrics, Inc. (“Company” or “we”). Individuals and households who join the MediaMagnitude panel (“Panelists” or “you”) choose to share a variety of digital, mobile, television, streaming video, and social media activity data (collectively, “Media Consumption Data”) with Company. Company uses this Media Consumption Data and shares it with our business customers (“Customers”) for research and advertising purposes including to understand consumers’ interests and preferences, improve products and services, enhance marketing and advertising, and other research, measurement, and analytics.

This Privacy Policy describes how we collect, use, and share information from Panelists, including through the Panel website at https://www.mediamagnitude.com/ (“Website”), the MediaMagnitude coreMeter or coreMeter mini (“Meters”), the MediaMagnitude Presence or Self-Installation mobile applications (“Applications”), and any other MediaMagnitude products or services that link to this Policy or that you use to participate in the Panel (collectively, the “Service”). This Privacy Policy also covers information that we collect from individuals and households who are screened or apply for our Panel.

I. Information Collected

i. Information You Provide

We collect information that you provide through your use of our Service. For example, if you contact us through our Website or via email, we may collect your name, contact information, and other information that you provide to us in your message.

We also collect information about you and other household members when you are screened or register to participate in our Panel. This information may include names, contact information, and other data such as age, gender, race, ethnicity, education, employment, marital status, and income. It also includes information about your devices, Internet connectivity, cable or Internet service providers, and any other information you choose to provide. We may request your Social Security Number if needed for tax purposes related to incentives you may receive for participating in the Panel.

We may also collect personal information from you when you participate in a survey. We may contact you about participation in our surveys by e-mail, text messages, mail, and other means. We may combine any information that we collect through surveys, our Website, and through your participation in our Panel with any other information that we collect from or about you.

ii. Information Collected through Panel Participation

When you join the Panel, we will collect Media Consumption Data on any device that you use to participate in the Panel, including smartTVs, cable or satellite boxes, streaming devices, gaming consoles, routers, or other devices connected to your network (each a “Device”). We may collect this information through our Meters or through meters provided by third parties for other panels on which you participate, such as Internet meters you use to participate in similar panels. The information collected through Meters may include content and advertising shown on your devices and your interactions with that content and advertising, as further described below. We may assign this Media Consumption Data to household members using a variety of technologies, such as our Application, a Bluetooth beacon provided by us, or a remote that Panelists can activate per session. We may collect location information based on IP address or Wi-Fi signal strength from Panelists that use our Application.

We may collect information about your web browsing activities and the use of applications on your device, including Internet and other network activity (such as websites you visit and time spent on those sites, software or applications that you download and use, and videos you watch) and commercial or transactions information (such as items you put in your shopping basket or other records of products or services you consider or purchase).  We may collect information that you submit online during both normal and secure sessions, such as information you submit when you complete a form, enter a prompt in an artificial intelligence tool, or check online accounts. When we collect information transmitted during a secure session, we take reasonable precautions designed to protect the security of the information that we collect, such as transmitting information through a secure connection. Additionally, the Service is designed to prevent collection of certain types of personal information, such as passwords, credit card numbers, credentials, and financial account numbers. If we discover that we have accidentally collected such information, we will take reasonable steps to destroy, encrypt, or otherwise secure it. The Service is not designed to collect the contents of your mail, email, or text messages.

We may collect certain Device and Application information from any Device through your participation on our Panel. This can include information such as your Device configuration, hardware, software, IP address, browser information, and advertising or device identifiers. For mobile devices, this can include information such as the model of the mobile device you are using, the amount of memory in the mobile device, and technical information about the device, such as model or operating system version. We may also collect information about device ownership, such as the name of your device services provider, and your opinions and attitudes related to all of the above.  We may collect information about your network, such as the number of Devices and the data volume on the network.

If you allow others to use Devices that are participating in the Panel, information about their use of your Device may also be collected.

iii. Information from Third Parties

In addition to the information collected through the Panel, we may also collect information about your Internet use from third parties, including search engines, email providers, social networks and other application service providers whose websites or mobile applications you visit. This information may identify the content that you view on those websites or mobile applications. We may combine this information with the information that you provide to us directly or through your participation in the Panel.

We may also obtain information from other third parties, including retailers, consumer data resellers, advertising companies, data analytics providers, or other panel providers to obtain Media Consumption Data that we may integrate with the information that we collect through the Service. In addition, we may collect contact information and other information about you from third parties that recruit or refer you as a Panelist.

iv. Information Collected Automatically from the Website

We (and other entities) may automatically collect information related to your interactions with us and our Website, including browser type, IP address, pages visited and other activities on the Website, device type, time and date of visit, and other information we collect through the use of cookies and similar technology. Please see the “Website Practices” section of this Privacy Policy to learn more about the use of this Website information and the choices available to you.

II. Use of Information

Participating in the MediaMagnitude Panel allows us to learn about your interactions with technology and digital media on various devices. This includes a wide range of devices (e.g., televisions, desktop and laptop computers, mobile phones, tablets, wearable devices, etc.) you may use to consume and interact with digital content throughout the day. Your information helps us understand behavior in your household, such as who is using or watching television in a particular room.

We may use the information collected through your participation in our Panel and your survey responses, combined with information from other sources, to provide reports, evaluations, and predictions on current and future media activities. Some products and services are provided in the form of aggregate reports that do not identify any individual. We may also provide information that identifies or allows the Customer to identify you as an individual.

Additionally, we may use the personal information that you provide to us:

  • To operate and improve our products and the Service, including this Website and our Applications;

  • To communicate with you, including to respond to your requests or provide information about our products and services;

  • To administer incentives that you receive in exchange for your participation in our Panel;

  • To provide our products and services to our Customers;

  • To comply with the law and to maintain the security of our Service;

  • With your consent, or as otherwise disclosed at the time information is collected.

We may use information that has been deidentified or aggregated without limitation.

III. Disclosure of Information

We disclose information to companies that are our Customers for market research purposes, to enhance their understanding of media consumption behavior and commercial trends. This may include providing our Customers with personal information in the form of individual records that identify or allow the Customer to identify you as an individual. Customers may process this personal information for their own purposes and in accordance with their own privacy policies, including by further disclosing the information.

We may also share information that we collect with companies who have referred you to us and requested that we provide them with information about your participation in our Panel (“Referral Partners”). These Referral Partners may also be able to match personal information that we provide with other information they have collected and may use the combined information to create a variety of reports, including market research reports.

Company makes commercially reasonable efforts to restrict those Customers and Referral Partners with whom we share personal information from using that information without your permission to target advertising or marketing back to you based solely on data collected through the Panel.  Customers and Referral Partners may use personal information for other advertising and marketing activities, and these activities may result in delivery of advertising to your Devices in a manner similar to other devices on the Internet.  We may also share any personal information that you provide to us for the following purposes:

  • With our vendors, consultants, agents, contractors, and other service providers that process information on our behalf to support our business, or with our legal or business advisors;

  • To communicate with you, including to respond to your requests or provide information about our products and services;

  • To provide you with any information or services that you request;

  • To respond to subpoenas, court orders, governmental inquiry, and other legal process, or as otherwise required by law;

  • To protect our legal rights including to enforce our contracts and respond to government inquiries, to otherwise protect our rights or the rights of third parties, or to protect the safety or security of any person or entity;

  • In connection with an actual or potential merger, sale, acquisition, assignment, or transfer of all or part of our assets, affiliates, lines of business, or products, including as part of a bankruptcy proceeding;

  • With our affiliated companies;

  • With your consent or as otherwise disclosed at the time of information collection or sharing.

We may share information that has been deidentified or aggregated without limitation.

IV. Website Practices

Our Website may contain links to third-party websites or apps. We do not control the privacy practices of these linked websites or apps, and this Privacy Policy does not apply to those websites or apps. We encourage you to read the privacy policy of any third-party website or app that you visit to learn more about their data practices.

The Website may also include integrated social media tools or “plug-ins,” such as social networking tools offered by third parties. If you use these tools to share personal information or you otherwise interact with these features on the Website, those companies may collect information about you and may use and share such information in accordance with your account settings, including by sharing such information with the general public. Your interactions with these third-party companies and your use of their features are governed by the privacy policies of the companies that provide those features. We encourage you to carefully read the privacy policies of any accounts you create and use.

We may work with third parties that collect information about your use of the Website and other sites or apps over time for non-advertising purposes using cookies and similar technologies. We use Google Analytics and other third-party services to improve the performance of the Website and for analytics and marketing purposes. Your browser may also offer tools to limit the use of cookies or to delete cookies; however, if you use these tools, our Website may not function as intended.

V. Withdrawing from the Panel

If you want to stop participating in the Panel, you may do so at any time by notifying Company in writing at help@mediamagnitude.com. We will provide instructions for removing the Meters and Applications, and otherwise stopping data collection associated with the Panel. You must follow all instructions in order to stop the data collection.

​

Company may terminate your participation in the Panel, and the Terms that govern your participation, for any reason and at any time. This may include terminating your participation in the Panel if the Meters are unable to collect sufficient data.

​

Upon termination, you will return to Company all Meters and any other hardware and software you received in connection with the Panel, or otherwise dispose of the hardware and software in the manner Company states (including, for example, uninstalling downloadable software). Upon termination, you will have sixty (60) days to redeem any incentives. If your participation in the Panel was terminated for cause (e.g., because you violated these Terms), you forfeit your right to redeem any incentives previously accrued.

Please note: After you withdraw, we may continue to use information collected during the time that you participated in the Panel, but all such information remains fully subject to, and governed by, the Privacy Policy that was effective at the time you stopped participating in the Panel.

VI. California Privacy Rights

California residents have certain rights under the California Consumer Privacy Act (“CCPA”) with respect to personal information we collect. If you are a California resident, this section of the Privacy Policy contains disclosures required by law and explains rights that may be available to you. This section applies to information considered “personal information” under the CCPA.

Personal Information We Collect and Disclose. In the preceding 12 months, Company collected and disclosed the following categories of personal information:

  • Personal and online identifiers (such as first and last name, date of birth, email address, Social Security number, or unique online identifiers)

  • Characteristics of legally protected classifications (such as race, ethnicity, or gender)

  • Commercial or transactions information (such as records of products or services purchased, obtained, or considered)

  • Internet or other electronic network activity information (such as browsing history, viewing history, search history, and interactions with a website, email, application, or advertisement)

  • Location information (such as location information derived from IP address or Wi-Fi signal strength)

  • Professional or employment-related information (such as employment status or income)

  • Education information (such as education level)

  • Information about consumers under 16, with parent or guardian consent

  • Inferences drawn from the above information about your predicted characteristics and preferences

  • Other information about you that is linked to the personal information above

Some of the categories of personal information listed above are considered sensitive personal information under the CCPA, namely Social Security number, race, ethnicity, precise geolocation information, and information about consumers under 16. We do not use or disclose Social Security number except for the purposes enumerated in the CCPA that do not require a right to limit. Other sensitive personal information that we collect may be disclosed to our Customers and Referral Partners or otherwise used in our services, and you can choose to limit such use of your sensitive personal information as described below.

Categories of Sources. We collect personal information from the following categories of sources:

  • Panelists

  • Affiliated companies

  • Referral Partners (defined above)

  • Service providers

  • Search engines

  • Email providers

  • Social networks

  • Application service providers

  • Retailers

  • Consumer data resellers

  • Advertising companies

  • Data analytics providers

  • Other market research panel providers

Our Purposes for Processing Personal Information. We use and disclose the personal information we collect for our commercial and business purposes, as further described in the “Use of Information” section of this Privacy Policy.

We may use and share aggregated or deidentified information to the extent permitted by applicable law. When we use deidentified information, we maintain and use the information in deidentified form and do not attempt to reidentify it, except to check whether our deidentification processes satisfy the requirements of applicable law.

Recipients of Personal Information. We disclose the categories of personal information listed above to the categories of third parties described in the “Disclosure of Information” section of this Privacy Policy. When we disclose personal information to our Customers and Referral Partners, we treat these disclosures as “sales” under the CCPA and give you the opportunity to opt out as described below. (We do not currently engage in “sharing” for cross-context behavioral advertising that requires an opportunity to opt out.)

Your Rights. California residents have rights with respect to the personal information we collect. You may be able to exercise the following rights regarding personal information, subject to certain exceptions and limitations:

  • The right to know the categories and specific pieces of personal information we collect, use, disclose, and sell about you; the categories of sources from which we collected personal information about you; our purposes for collecting or selling personal information about you; the categories of personal information about you that we have sold or disclosed for a business purpose; and the categories of third parties with which we have shared personal information.

  • The right to correct inaccuracies in the personal information we have collected about you.

  • The right to request that we delete the personal information we have collected about you.

  • The right to opt out of our sales of personal information. Please note that if you opt out of certain practices, you may be required to withdraw from the Panel and we may be unable to provide you with some services. Panelists aged 13 through 15 must individually opt into sales during the Panelist registration process.

  • The right to limit our use of your sensitive personal information to certain uses enumerated by the CCPA.

  • The right not to receive discriminatory treatment for the exercise of the above privacy rights.

To exercise any of the above rights, please contact us online at privacy@mediamagnitude.com. Your request should provide, at a minimum, your full name and email address. We may need to request additional information from you to verify your identity or understand the scope of your request. You will not be required to create an account with us to submit a request or have it fulfilled.

Authorized Agent. You can designate an authorized agent to make requests on your behalf by designating such an agent in writing or through a power of attorney. We will require the agent to provide us with proof that you have authorized the agent to make requests on your behalf prior to accepting requests from the agent.

Retention. We retain personal information in identifiable form only for as long as necessary to fulfill the purposes for which the personal information was provided to us or to comply with legal obligations, to resolve disputes, to enforce agreements, or to satisfy any similar essential purposes. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we process personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. Once the retention period expires and if not otherwise required to retain information by law, we will delete or deidentify the personal information.

VII. Nevada Privacy Rights

Under Nevada law, Nevada residents may submit a request directing us not to make certain disclosures of personal information we maintain about them. To exercise this right, you may contact us at privacy@mediamagnitude.com. We will provide instructions for removing the Meters and Applications, and otherwise stopping data collection associated with the Panel.

VIII. Notice of Financial Incentive

We provide you with opportunities to receive payments and incentives in exchange for participating in our Panel. We may collect and disclose this personal information as described in above, including in the “California Privacy Rights” and “Information Collected” and “Disclosure of Information” sections of this Privacy Policy.

The terms associated with your Panel participation, like the amount you will receive if you qualify for and install the Meter, are presented to you when you register as a Panelist. The terms associated with each survey, like the amount you will receive if you qualify and complete the survey, are presented with each survey offer. Under California law, because we offer you payments related to the collection and sharing of personal information, our Panel is considered a “financial incentive” program. Incentives can be redeemed through the MediaMagnitude Presence app.

You opt into these financial incentives by registering for the Panel, including by agreeing to our terms, and installing our Meters on your Devices. If you no longer wish to participate in the financial incentive program, you can withdraw from the Panel at any time by contacting us at help@mediamagnitude.com. We will provide instructions for removing the Meters and Applications, and otherwise stopping data collection associated with the Panel. You must follow all instructions in order to stop the data collection. Upon termination, you will return to Company all hardware and software you received in connection with the Panel or otherwise dispose of the hardware and software in the manner Company states (including, for example, uninstalling downloadable software). Upon termination, you will have sixty (60) days to redeem any incentives. If your participation in the Panel was terminated for cause (e.g., because you violated these Terms), you forfeit your right to redeem any incentives previously accrued.

The amount of payment you receive for participating on the Panel, including for responding to a specific survey, is based on the reasonable determination of the value that we and our Customers and Referral Partners receive from processing personal information. The estimated value takes into account a variety of factors as permitted by law, including (but not limited to) the expenses incurred in collecting and retaining the information, the expenses incurred in providing payments to you, and the estimated marginal value derived from information collected through our Panel.

IX. Children’s Privacy Notice

When your household participates in a Panel by installing the Meter, we will monitor Media Consumption Data on any device connected to your network, including the behavior of any children under 13 in your household. We collect the same information from children as we do from other individuals participating in the Panel. This information is described in the “Information Collected” section of this Privacy Policy. We also use and disclose information collected from children in the same way that we use and disclose information from other individuals participating in the Panel. Our use of this information and the parties to which we disclose this information are described in the “Use of Information” and “Disclosure of Information” sections of this Privacy Policy. Children do not have the ability to make personal information publicly available through the Service.

Where required by law, we obtain consent during the Panel registration process from a verified parent or guardian for our collection, use, and disclosure of information from children under 13 in the household.

  • Parents may review and/or request that we delete any personal information we have collected from your children through the Panel by contacting us as described below.

  • If you do not want us to make any further use of personal information that we have previously collected from your child, please make a request to delete the information.

  • If you do not want us to continue collecting information from your child, please withdraw from the Panel as described in the “Withdrawing from the Panel” section of this Privacy Policy.
